Terms and Conditions

These terms govern your use of xtremetop300. They are written to be read, and to describe what the site actually does — including the parts that are not in our favour.

1. Who you are contracting with

xtremetop300, operated from Romania. Write to [email protected] about anything on this page — it reaches a person, and we answer.

2. What the service is

A directory and ranking of game servers. Players browse and vote; server owners list their servers and may pay for extra visibility. Listing a server is free.

We do not run any of the listed servers. We do not vet their content, their stability, their in-game purchases or their conduct, and we are not a party to anything between you and them. Clicking through to a server takes you somewhere we do not control.

3. Your account

• Give a real email address; you need it to confirm the account and to recover it.
• One account per person. Extra accounts used to gain an advantage will be removed.
• You are responsible for what happens under your account. Tell us if you lose control of it.
• You must be at least 16, or old enough to agree to this where you live.

4. What may be listed

Game servers, gaming guides, and guilds or communities with their own website. Nothing else.

A listing must not:

• contain or link to malware, phishing, or anything that installs itself;
• contain adult content, or content aimed at children in a way that would be unsafe;
• infringe someone else's trade mark, copyright or branding, or imitate another server;
• misrepresent what the server is — wrong game, wrong rates, a dead address, a description of something else;
• be unlawful where it operates, or promote anything unlawful.

You keep ownership of what you upload. You give us permission to display it on the site and in the search results and previews that follow from that. You confirm you have the right to give that permission — which matters most for banners and artwork.

5. Voting, and interfering with it

Votes are the ranking. One vote per person per server per 24 hours, and votes reset at the start of each month.

You must not, and must not ask anyone else to:

• vote more than once by clearing cookies, changing address, or using a VPN, proxy or hosting provider to appear to be several people;
• use scripts, bots, emulators or paid services to cast votes;
• pay for votes, or exchange them.

We check every vote automatically. A vote that fails a check is recorded but not counted, and a person reviews it — nothing is deleted, so an honest vote wrongly flagged can be restored. Where a listing benefits from manipulated voting we may remove those votes, recount the ranking, and suspend or remove the listing. For deliberate or repeated manipulation we may close the account without refunding unspent coins.

We do not promise any ranking position. The ranking is what the votes say.

6. Paid promotion and coins

Coins

Coins are prepaid credit for services on this site. One coin costs 1.00 EUR, and larger purchases earn bonus coins at the thresholds shown on the pricing page. Coins:

• are not money, not a payment instrument, and cannot be transferred or sold;
• do not expire;
• are not exchangeable back into cash, except where the law requires a refund;
• have no value outside this site, and none if your account is closed for breaking these terms.

Premium listings

A premium listing gives visual prominence, your banner in the toplist, and +100 votes credited at each monthly reset, for 30 days.

Stated plainly because it is the honest description: premium is a head start, not a reserved position. It does not place you above servers that earned more votes, and a server that campaigns harder will pass you. If that is not what you want, do not buy it.

Payment and the right to withdraw

Payments are taken by Stripe. Prices include VAT where it applies.

As a consumer in the EU you normally have 14 days to withdraw from a distance purchase. Coins are credited as soon as your payment clears, which is immediate performance of the contract — so at checkout you are asked to confirm that you want them credited straight away and that you understand you then lose the withdrawal right. That confirmation is required, and we record when it was given.

If you have not given it, or where the law says otherwise, the 14-day right applies as usual: write to [email protected] and we will refund the purchase. Coins already spent on a service we have delivered are not refundable, and a premium period already running is a service already performed.

If we fail to deliver something you paid for, you are entitled to it or to your money back. That is not a favour and nothing in these terms takes it away.

7. Moderation, dormant listings, removal

New listings are reviewed before they appear. We may edit an obviously wrong detail, ask you to fix something, or refuse a listing that breaks section 4. Where we hide or refuse a listing we record a reason and you can see it on your dashboard.

Dead servers are removed. A directory full of servers that no longer exist is useless, so if a listing is unreachable for around 21 days and takes no votes in that time, we email you, wait 14 days, and then hide the listing if we hear nothing. Nothing is deleted: your votes and settings are kept, and one click on the link in that email brings the listing straight back.

You may delete your account and listings at any time from your account page.

8. Availability

We try to keep the site up and the data accurate, but we do not guarantee either. Live player counts and uptime are measurements taken at intervals, and a measurement can be wrong or stale. We may change, suspend or discontinue features. If we discontinue a paid feature you have already paid for, we will refund the unused part.

9. Liability

We are liable for damage we cause by intent or gross negligence, for death or personal injury caused by our negligence, and for anything else the law does not allow us to exclude. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, or for lost players, revenue or rankings; and our total liability for paid services is limited to what you paid us in the twelve months before the claim.

Nothing here limits your rights as a consumer under the law of the country you live in.

10. Changes to these terms

We may update these terms. For a change that materially affects your rights or a paid service, we will tell account holders by email at least 14 days beforehand, and you may stop using the service and ask for a refund of anything unused rather than accept it. Continuing to use the site after that means you accept the change.

11. Law and disputes

These terms are governed by the law of Romania, and disputes belong before its courts — except that if you are a consumer, you keep the protection of the mandatory law of the country you live in, and you may also bring proceedings there.

Talk to us first: most things are settled by email. EU consumers may also use the European Commission's online dispute resolution platform.

How we handle personal data is set out in the privacy policy, which forms part of these terms.
